Orders of Protections / Injuctions Against Harassment
LaFaro v. Cahill, 203 Ariz. 482, 56 P.3d 56 (Ct. App., Div. 1., 2002) (PDF 248 KB)
Alleged harassment victim sought injunction against harassment. The Superior Court issued injunction prohibiting alleged harasser from any "in person" contact with alleged harassment victim. Alleged harasser appealed. The Court of Appeals held that: (1) injunction was a final, appealable order; (2) single conversation between alleged harasser and alleged harassment victim did not come within purview of statute proscribing harassment; (3) injunction against harassment was unconstitutionally overbroad; and (4) statute authorizing injunction against harassment is not unconstitutional in all potential applications.
